SeaterOS Terms of Service

1. Acceptance of Terms
By accessing or using the SeaterOS platform, website, or mobile applications (collectively, the "Service"), whether as a guest making a reservation ("Customer") or as a restaurant/business owner ("Venue"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service.
2. Service Description
SeaterOS provides reservation management, table management, and customer relationship software for the hospitality industry. We allow Customers to make online bookings at participating Venues. SeaterOS acts as an intermediary software provider and does not own, operate, or control the Venues listed on our platform.
3. Booking Policies and "No-Show" Prevention
To protect our Partner Venues from lost revenue and ensure fair access to tables for all users, SeaterOS enforces a strict double-booking policy:
- No Double-Booking: Customers are strictly prohibited from making multiple, overlapping reservations at different Venues for the same date and time (or within a 2-hour window) using the same email address or phone number. If the system detects a conflict, you will be required to cancel your existing reservation before securing a new one.
- No-Shows & Cancellations: Each Venue maintains its own cancellation and no-show policies. Customers are responsible for reviewing these policies during the booking process. The final determination of what constitutes a "no-show" and the enforcement of any associated cancellation fees rests entirely with the Venue. SeaterOS is not responsible for, nor do we arbitrate, disputes regarding cancellation charges.
- No Reselling: Customers may not book tables with the intent to resell or transfer the reservation to third parties for a profit.
4. The SeaterOS Local Tourism Network (For Venues)
By using SeaterOS, Partner Venues acknowledge that they are joining a broader ecosystem designed to enhance local tourism:
- Network Participation: Venues acknowledge that SeaterOS operates local tourism guides and promotional networks. While the Venue retains ownership of its specific CRM data (e.g., dining history, customer notes), the Venue agrees that SeaterOS may collect contact information from Customers who explicitly opt-in during the booking process to receive local guides, offers, and recommendations from our affiliated tourism companies.
- Non-Poaching Commitment: SeaterOS commits to ethical marketing. We will never use data collected through a specific Venue's booking portal to directly solicit that Customer to cancel their booking in favor of a direct, named competitor for the exact same date and time. Our network marketing focuses on enhancing the overall destination experience.
5. User Responsibilities & Account Security
Venues are responsible for maintaining the confidentiality of their account login credentials and for all activities that occur under their account. Customers must provide accurate, current, and complete information when making a reservation. SeaterOS reserves the right to suspend or terminate accounts or block access to the Service if we suspect fraudulent activity or a breach of these Terms.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEATEROS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL SEATEROS, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE TO ANY PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Liability Cap: In any event, the total aggregate liability of SeaterOS arising out of or related to these Terms or your use of the Service, whether in contract, tort, or otherwise, shall not exceed the amount you paid to SeaterOS in the twelve (12) months preceding the claim, or two hundred Euros (€200), whichever is greater.
7. Indemnification
You agree to indemnify, defend, and hold harmless SeaterOS and its affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
8. Changes to Terms
SeaterOS reserves the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this document or by sending an email notification. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Greece. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Athens, Greece.
